This policy explains what personal data Fortbay Premium Beverage Ltd (“Fortbay”, “we”, “us”) collects when you use fortbay.ng, why we collect it, who we share it with and the choices you have. We process personal data in line with the Nigeria Data Protection Act 2023 (NDPA).
1. Who we are
Fortbay Premium Beverage Ltd operates the Fortbay online drinks store, with locations in Maitama, Abuja & Victoria Island, Lagos. For anything about your personal data, contact us at orders@fortbay.ng or 0803 000 0000.
2. What we collect
When you place an order
- Your name, phone or WhatsApp number, email address, delivery address and any delivery instructions.
- Your delivery city or region, the products and quantities you order, the payment method you choose and any promo code you use.
When you contact us on WhatsApp
Buttons on the site open WhatsApp with a pre-written message (for example your order, an enquiry or a request for a bundle's price). We receive whatever you choose to send, along with your WhatsApp name and number. WhatsApp is run by Meta, which processes your messages under its own privacy policy.
When you join our newsletter
Your email address, the page you signed up on and the date you joined (and, if you leave, the date you unsubscribed).
When you browse the site
We use our own analytics, not third-party tracking, to understand how the store is used. Your browser is given a random visitor ID and a random visit ID. Against those IDs we record the pages you open, the products you view, items you add to or remove from your cart or wishlist, what you type into the site's search box, promo codes you try, when you click a WhatsApp button or place an order, your device type (mobile, tablet or desktop, worked out from your browser) and the website that referred you. We do not store your IP address, and we do not link these records to your name or contact details.
Information stored on your device
The site stores a small amount of information in your browser so that it works properly:
- your cart and wishlist;
- that you have confirmed you are 18 or older;
- the random visitor and visit IDs used for analytics;
- whether you have already seen our special-offer pop-up during this visit.
We do not use advertising or third-party tracking cookies. Staff who sign in to our admin area receive a security cookie that keeps them signed in. You can clear the stored information at any time through your browser settings; your cart and wishlist will be emptied if you do.
3. How we use your data, and why we are allowed to
- To take, deliver and support your orders, including contacting you about your order by phone, WhatsApp or email. This is necessary to perform our contract with you.
- To send you our newsletter and offers, only if you have joined it. This is based on your consent, which you can withdraw at any time.
- To understand and improve the store, for example which products people look for and where they leave. This is in our legitimate interests, and the analytics we use are designed not to identify you.
- To keep the store secure and prevent abuse, such as limiting repeated attempts to guess promo codes. This is in our legitimate interests.
- To meet our legal obligations, such as keeping accounting and tax records and checking that our customers are of legal drinking age.
4. Who we share your data with
We do not sell your personal data. We share it only with:
- the people who deliver your order, who receive the name, phone number and address needed to deliver it;
- companies that host our website and database for us, which store data on our behalf and may not use it for anything else;
- WhatsApp (Meta), when you choose to contact us there;
- a payment provider, if you pay by card through one. The provider processes your card details directly; we never see or store your card number;
- authorities or others where the law requires it, or to protect our rights, our customers or the public.
5. Transfers outside Nigeria
Some of the services we use to host the site and our database store data on servers outside Nigeria. Where that happens, we rely on the safeguards allowed under the NDPA to make sure your data stays protected.
6. How long we keep your data
- Order records are kept for as long as we need them for accounting, tax and other legal purposes.
- Newsletter details are kept while you are subscribed. If you unsubscribe, we keep a record of that so that we don't email you again.
- Analytics records are anonymous and kept for as long as they are useful for understanding how the store is used.
7. Your rights
Under the NDPA you have the right to:
- ask for a copy of the personal data we hold about you;
- ask us to correct data that is wrong or incomplete;
- ask us to delete your data where we no longer have a reason to keep it;
- object to, or ask us to restrict, how we use your data;
- receive your data in a commonly used format and have it sent to another organisation;
- withdraw your consent at any time, for example by unsubscribing using the link in any newsletter email.
To use any of these rights, email orders@fortbay.ng. We may need to confirm your identity first. If you are unhappy with how we have handled your data, you can complain to the Nigeria Data Protection Commission (ndpc.gov.ng).
8. Age restriction
Fortbay sells alcoholic drinks and is only for people aged 18 or older. We do not knowingly collect personal data from anyone under 18. If you believe someone under 18 has given us their details, please contact us and we will delete them.
9. Security
The site is served over an encrypted (HTTPS) connection, and access to customer and order information is restricted to authorised staff. No system is completely secure, but we take reasonable steps to protect your data.
10. Changes to this policy
We may update this policy from time to time. The date at the top shows when it last changed. If we make significant changes, we will make them clear on the site.
