Terms of Service

These terms apply when you use fortbay.ng and when you order from Fortbay Premium Beverage Ltd (“Fortbay”, “we”, “us”), whether through the site or on WhatsApp. By using the site or placing an order you agree to them. Our Privacy Policy explains how we handle your personal data.

1. You must be 18 or older

We only sell alcoholic drinks to people aged 18 or older. By using the site or ordering, you confirm that you are. We may ask for proof of age when we deliver, and we may refuse to hand over an order, and cancel it, if we are not satisfied that the person receiving it is 18 or older.

2. Products

• We describe our products as accurately as we can, using information from their producers. Photos are for illustration, and labels, packaging or vintages may differ slightly from what is shown.
• All products are subject to availability. If something you ordered is unavailable, we will contact you to offer an alternative or a refund for that item.
• Bundles and cartons are priced on request. Use the “Message for Price” button to ask us on WhatsApp; the price we quote applies to that enquiry only.

3. Prices, fees and promo codes

• Prices are in Nigerian Naira (₦) and are shown on the site at the time you order.
• Delivery costs ₦2,500 in Abuja and Lagos and ₦5,000 elsewhere, and is free on orders of ₦100,000 or more. A temperature-packaging fee of ₦500 applies to each order. The full total is shown before you confirm.
• Only one promo code can be used per order. Codes have no cash value, can't be exchanged, and may be changed or withdrawn at any time. A code is applied only if it is valid when your order is placed.
• If we have made an obvious mistake in a price, we will contact you before processing your order and you may choose to continue at the correct price or cancel.

4. Orders and payment

• When you place an order you are making an offer to buy. We will confirm your order and the payment details, and the contract is formed once we accept it. Your order reference confirms that we have received it, not that it has been accepted.
• The payment methods available are shown at checkout. We dispatch orders once payment has been received and confirmed.
• We may decline or cancel an order, for example if a product is unavailable, a price was wrong, payment isn't received, or we can't confirm the buyer's age. If you have already paid, we will refund you in full.

5. Delivery

• We deliver to: Abuja (Maitama, Asokoro, Wuse 2, Jabi); Lagos (Ikoyi, VI, Lekki Phase 1, Ikeja); Port Harcourt (GRA Phase 1 & 2); Other State (Nationwide Express).
• Delivery times shown on the site are estimates and are not guaranteed. We will keep you updated if your order is delayed.
• Please make sure your address and phone number are correct and that someone aged 18 or older is available to receive the order.

6. Problems with your order

If your order arrives damaged, incorrect or incomplete, please contact us as soon as possible at orders@fortbay.ng or 0803 000 0000, with your order reference and, if you can, a photo. We will work with you to put it right, which may mean a replacement or a refund. Nothing in these terms affects your rights under the Federal Competition and Consumer Protection Act 2018 or other applicable law.

7. Responsible drinking

Please drink responsibly. Never drink and drive. Do not buy alcohol on behalf of anyone under 18.

8. Using the site

• You agree not to misuse the site, for example by trying to disrupt it, gain unauthorised access, or place fraudulent orders.
• The site's content, design and our branding belong to us or to the brands we sell, and may not be copied without permission. Product names and logos are the trademarks of their owners.

9. Our responsibility to you

We are responsible for losses you suffer that are a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for losses that were not foreseeable, or for business losses. Nothing in these terms limits our liability where it would be unlawful to do so.

10. Changes to these terms

We may update these terms from time to time. The version on the site when you place an order is the one that applies to that order.

11. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and the Nigerian courts have jurisdiction over any dispute.
